An Ordinance Amending Title 2 (Administration and Personnel), Chapter 2.56 (Urban Renewal Agency) of the Hood River Municipal Code by Transferring the Powers of the City’s Urban Renewal Agency to a Nine Member Board Consisting of the Council and Two Commissioners of the Port of Hood River
The City Council of the City of Hood River, Oregon, finds as follows:
WHEREAS, pursuant to the authority in ORS chapter 457, the City Council created the Hood River Urban Renewal Agency in 1986 (Ordinance No. 1579), with a seven member board, consisting of three city councilors, two Port of Hood River commissioners, one member of the Planning Commission, and one member from the public at large; and
WHEREAS, the authority and structure of the Hood River Urban Renewal Agency was codified in Chapter 2.56 of the Hood River Municipal Code (HRMC); and
WHEREAS, ORS 457.055 authorizes the City Council to transfer the authority to exercise the powers of the urban renewal agency to any other body authorized to exercise those powers under ORS 457.045; and
WHEREAS, the Hood River City Council finds that it is appropriate to reformulate the governing body of the Hood River Urban Renewal Agency and vest its authority in a 9-member board consisting of all seven City Councilors and two Port Commissioners; and
WHEREAS, the City Council considered this proposal at its duly noticed regular meeting on ________________, at which meeting it also allowed and considered public testimony on the proposal.
NOW THEREFORE, based on the foregoing Findings, the City Council of the City of Hood River, Oregon, Ordains as follows:
Section 1 – Reformulation of the Hood River Urban Renewal Agency. The Hood River Urban Renewal Agency is hereby reformulated from a 7-member board to a 9-member board, consisting of seven of the currently seated members of the City Council and two currently seated Commissioners of the Port of Hood River, to be selected by the Port of Hood River and subject to approval by the city .
Section 2 – Amendment of HRMC chapter 2.56. Title 2 (Administration and Personnel), Chapter 56 (Urban Renewal Agency) of the Hood River Municipal Code, section 2.56.020 shall be amended to read as follows:
2.56.020 Urban Renewal Board – Composition and Quorum. The City Council elects to have the powers of an urban renewal agency exercised pursuant to ORS 457.045(2) by the Hood River Urban Renewal Agency, governed by a board consisting of nine members as follows:
A. Seven board members shall be the then-current members of the City Council, each serving terms concurrent with their terms as city councilors.
B. Two board members shall be active commissioners of the Port of Hood River, which shall be appointed by the Port of Hood River, subject to approval by the City Council and shall serve terms of two years.
C. A quorum of the Urban Renewal Board shall be a majority of the then-currently filled Board positions. (Ord. 1585, 1987; Ord. 1579, 1986, Ord. ____, 2012)
Section 2 – Reconciliation of Existing Urban Renewal Resolutions and Enactments. All resolutions, operating rules, bylaws and similar enactments of the Hood River Urban Renewal Agency that are in effect on the effective date of this 2012 Ordinance shall remain in effect except to the extent that they conflict with the provisions of this Ordinance. Any such provisions that conflict with this Ordinance shall be null and void.
Read for the First Time this 26 day of March 2012.
Read for the Second Time and approved this 9 day of April 2012. This Ordinance shall take effect on the 31st day following the second reading.
